Terms of Service

By downloading, accessing, or using the FareChance mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

FareChance is a local discovery app that helps you decide where to eat, drink, and explore. Build custom lists, called Decks, of your favorite venues or anything else, and let the App randomize the choice for you. FareChance also provides curated venue recommendations based on your location.

The App is designed for entertainment and personal decision-making. It is not a booking, ordering, or review platform.

FareChance offers optional in-app purchases. FareChance+ is an auto-renewing subscription that removes third-party ads and unlocks the price and rating filters. It is offered on monthly and annual terms at the price shown in the App at the time of purchase.

Payment is charged to your Apple ID account when you confirm the purchase. Your subscription renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the price in effect for your plan.

You can view, manage, and cancel your subscription in your Apple ID account settings. Deleting the App does not cancel your subscription. If we change the price of a plan, the change applies only after Apple notifies you and you agree to the new price.

The Tip Jar offers one-time purchases that support development. Tips are voluntary, unlock no features, and are not refundable.

All purchases are processed by Apple, not by FareChance LLC. Refund requests are handled by Apple under the App Store's terms. We cannot issue refunds directly. Contact support@farechanceapp.com and we will help where we can.

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement and that you have the legal capacity to agree to these Terms.

You are responsible for any content you create within the App. You agree not to:

• Violate any applicable law
• Create unlawful, offensive, or infringing content
• Infringe upon the intellectual property rights of others
• Interfere with or disrupt the operation of the App

We reserve the right to modify or remove features at any time.

The App, including its design, branding, and underlying software, is owned by FareChance LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You retain ownership of the content you create, such as your Decks.

FareChance provides randomized selections and curated suggestions. We do not guarantee the accuracy of curated content, the availability or quality of any selected business or service, or any particular outcome from using the App. Use of the App is at your own discretion and risk.

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, FareChance shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed $1 USD.

You agree to indemnify and hold FareChance LLC harmless from any claims, damages, or expenses, including reasonable attorneys' fees, arising from your use of the App or your violation of these Terms.

The App uses third-party services to support its operation, including:

• Google Firebase, for curated content delivery, app analytics, and performance monitoring. Google's privacy policy applies: policies.google.com/privacy
• Advertising providers, which may display venue promotions and collect device identifiers in accordance with their own privacy policies

We are not responsible for the practices or content of third-party services.

We may suspend or terminate your access to the App at any time, without notice, for any reason, including violation of these Terms.

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@farechanceapp.com. We will attempt to resolve the dispute informally for at least 30 days before either party initiates arbitration.

Any dispute that cannot be resolved informally shall be settled by binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court. You and FareChance waive any right to a jury trial or to participate in a class action.

You may opt out of this arbitration agreement by emailing support@farechanceapp.com within 30 days of first accepting these Terms.

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of law principles.

We may update these Terms from time to time. Updated Terms will be posted with a revised effective date. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms constitute the entire agreement between you and FareChance regarding the App. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them without our consent.
